GENERAL
In this document, the following definitions will apply:
GUIDELINES AND BACKGROUND INFORMATION
Au Pairs are young adults aged between 17 & 27 years old, this age range being specified by Home Office Regulations. They are coming to England primarily to improve their English and live with English speaking families. They must be provided with their own bedroom by the family and live as part of the family. They must have full board and be given the opportunity to attend English classes. The Agency can help you and the Au Pair locate the nearest suitable college providing English tuition prior to their arrival. All costs of providing the English tuition will be the responsibility of the family/the Au Pair. The Agency will also provde the Au Pair with an informal list of other Au Pairs contact numbers in the local area who are willing to be contacted by fellow Au Pairs so they may settle quickly within the Family and feel at home.
Home Office Regulations
Au Pairs arriving in England are governed by Home Office Regulations which all reputable agencies abide by. The contents of this document are drafted in accordance with these Regulations. The Regulations state that all Au Pairs arriving from NON EC countries must only work 25 hours per week and have two full days per week free, plus time for studies and be hosted by English speaking families.
Duties of an Au pair
Au Pairs are not to be regarded as Domestics and are not required to have formal qualifications. They generally help the Family with light housework related to the children, meals, bath-times, collecting children from school etc but will often not be willing to do general cleaning. They will usually be expected to babysit two or three evenings per week but we recommend that an Au Pair should not be left in sole unsupervised charge of children under two years of age.
Hours of Work and Pocket Money
There are two types of Au Pair provided by the Agency subject to the Family's requirements namely Standard Au Pairs and Au Pairs Plus. Please note that with the exception of this clause the expression Au Pairs applies to both Standard Au Pairs and Au Pairs Plus.
Standard Au Pairs generally work approximately 25 hours per week, often for 2 hours in the morning and 3 hours in the afternoon. However, this can be altered subject to agreement by both parties. They will also expect to babysit one or two evenings per week. We suggest payment of a minimum of £65 pocket money per week.
Au Pairs Plus generally work approximately 30 - 40 hours per week and babysit for 2 - 3 evenings a week. We suggest payment of a minimum of £75 pocket money per week. All categories must have two free days a week and this should include at least one weekend a month. They must be paid weekly and on time. If you require them to collect children from school then their travel fees should be paid.
TERMS & CONDITIONS
Travel to the Family
This is paid for by the Au Pair as far as central London - the Family are responsible for meeting up with the Au Pair after this and must ensure that appropriate arrangements are in place to collect the Au Pair on arrival.
Holiday
After an initial six month period of stay, the Au Pair is entitled to paid holiday such paid holiday amounting to at least two weeks in every 12 months. They are also entitled to have Public holidays as free days without loss of pay.
Please note that this provision also needs to be read in conjunction with any domestic U.K. employment regulations which may from time to time be applicable.
Family Information
The provisions outlined in this document comprise The Terms and Conditions of Aupairs4London.co.uk which will be deemed as accepted by completion and submission of the on-line Registration Form. All records, documents and information submitted will be treated as confidential and remain the property of Aupairs4London.co.uk. Any documents sent to you regarding an Au-Pair are to be treated as confidential. The passing on of these documents to another potential employer renders the Family liable for the payment of the Agency fee set out below. Any documentation provided which is not required by the Family must be returned to the Agency immediately and at the Familys expense.
Introduction Fees
When a Family registers with the Agency, the Registration Fee specified in the table below will automatically become payable.
Upon placing Au Pairs, the Agency will immediately become entitled to invoice the Family for Placement Fees such fees to be based upon the duration of the placement that the Au Pair is placed for and as set out in the table of fees below.

Payment of fees
All Placement Fees due to the Agency will be invoiced upon selection of an Au Pair by the Family, such invoices to be settled in full within 28 days of being presented by the Agency or at least 7 days prior to the arrival of the au pair or start date of the placement which ever is the earliest. The payment must also be accompanied by a signed letter of acceptance.
In the event that the invoices are not settled in accordance with the provision above, or a signed letter of acceptance is not provided by the Family, the Agency is entitled to either:
The Agency warrents to the Family that any cheque provided in settlement of Agency fees will not be presented for payment until your Au Pair's travel dates and arrangements have been confirmed.
Conditions of refunds and replacements
In the event of cancellation by the Family after the Au Pair has accepted the offer of a placement but before they have purchased a travel ticket, The Agency will refund 50% of the Placement fee.
Should the Family cancel after the Au Pair has accepted and after s/he has bought a travel ticket, The Agency will not offer any refund.
If the Au Pair cancels before they arrive at the point of entry into the UK, The Agency will offer a free replacement or a refund of 100% of the Placement Fee minus £75 administration charge.
Should the Au Pair leave within one month of placement,

a free replacement Au Pair will be offered, but if no replacement is found within a period of 2 weeks, Aupairs4London.co.uk will offer a partial refund of the Placement Fees based upon the duration that the Au Pair did spend with the Family, as follows:
0 - 14 days
70% refund
15 - 30 days
50% refund
Provided that no refund or replacement will be offered if in the reasonable opinion of the Agency, the Au Pair has left due to behaviour or conduct by the Family which is unreasonable or unacceptable or working conditions which are unacceptable.
Should the Au Pair leave after 4 weeks, no refunds or a free replacement will be made by The Agency
In the event the Au Pair leaves the Family for her/his personal reasons earlier than originally proposed, the Agency will not be held responsible for any loss or additional expense incurred by the Family as a result.
Family Responsibilities
All Families are responsible for board, accommodation and for giving pocket money to the Au Pair as confirmed in their Family Registration Form. All Families should allow time for the Au Pair to visit language courses. All Families must behave according to general Au Pair rules and in particular the Home Office Regulations with regard to working hours, days off, duties, pocket money etc.. All Families are also responsible for meeting the Au Pair at her/his point of arrival in the UK. If the Au Pair is not met, she/ he may be placed at another family and no refunds or replacements will be made. It is the responsibility of the family to protect the Au Pair in their care from accident and illnesses and shall provide appropriate insurance as applicable. If an Au Pair is required to drive in a Family, it is up to the Family to provide adequate car insurance and driving lessons (if necessary) at the expense of the host family. In the event of termination of the placement agreement by either the Family or Au Pair, either party must give at least one weeks notice to the other. It is the Family's responsibility to provide accommodation and pocket money during this period as normal.
LIMITATIONS ETC.
The parties hereby agree that this document only purports to create a contractual relationship between the Agency and the Family and is only intended to cover introductions by the Agency. It does not create a contractual relationship between the Agency and the Au Pair. It does also not create an ongoing contractual relationship between the Agency and the Family during the time that the Au Pair remains with the family.
To the extent that the law allows, the Agency hereby excludes any liability for loss and damage to either the Family or the Au Pair howsoever caused.
No warrenty is provided by the Agency to the Family in respect of any details it provides regarding any discrepancies in the history, character, age, capability, references and other paperwork and the onus is on the Family to undertake any background checks which they feel are necessary.
The Agency will endeavour to find an Au Pair suitable for the Family's requirements but gives no warranty as to the suitability for or the reliability of the Au Pair for any placement. Aupairs4London.co.uk reserves the right at its absolute discretion to reject any Family or Au Pair during the process of application.
Aupairs4London.co.uk reserves the right to use its discretion in any situation not covered in this document. Any contract between the Agency and the Family is subject to the Law of England and Wales and all disputes arising out of any such contract shall be subject to the exclusive jurisdiction of the Courts of England and Wales. The Family confirms that they have read and agree to the Terms and Conditions of Business of The Agency. The Family understand Au Pairs are not qualified in Childcare and therefore they should not be given sole charge of children under the age of 2. The Family understand The Agency cannot be held responsible for any loss, damage or injury caused to persons or property by their Au Pair. The Family confirms that they have read and agree to abide by the Terms and Conditions regarding Au Pair placement by the completion and submission of the on-line Family Registration form.
Application Form
Prior to completing this form, please read the 'Terms and Conditions' pages above. Once your registration fee is received, we will make available to you comprehensive details of selected Au Pair candidates. We recommend that you complete the form as fully as possible (a few extra seconds spent now will save much time later on).
